Air Filtration operates this store and website, including all information, content, features, tools, products, and related services to provide you, as a customer, with a personalized shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service (the “Terms”) and any policies referenced here describe your rights and responsibilities when you use the Services.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. Air Filtration may accept or reject your order at its discretion. Your order is accepted only when we confirm acceptance and after we receive and process payment. Review your order carefully before submitting; we may be unable to accommodate cancellations after acceptance. If we reject, modify, or cancel an order, we will attempt to notify you using the contact details provided with the order.

You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 – PRICING & BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless stated otherwise, displayed prices exclude taxes, shipping/handling, and any customs or import fees.
Online prices may differ from prices offered elsewhere. Promotions may be governed by terms separate from these Terms; if there is a conflict, the promotion terms control.
You agree to provide current, complete, and accurate purchase, payment, and account information and to promptly update your account details (email, card numbers, expiry dates, etc.). You represent and warrant that you are authorized to use the payment method provided and will honor the amounts charged.

SECTION 5 – SHIPPING & DELIVERY

Shipping timelines are estimates and not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we hand off products to the carrier.

The Services—including trademarks, trade dress, text, images, graphics, videos, reviews, and the design, selection, and arrangement thereof—are owned by Air Filtration, its affiliates, or licensors and are protected by applicable intellectual property laws.

Nothing in these Terms grants any license to Air Filtration, Shopify, or third-party IP. All rights not expressly granted are reserved by Air Filtration.
Air Filtration names, logos, product and service names, designs, and slogans are trademarks of Air Filtration or its affiliates/licensors. You may not use them without our prior written consent.

SECTION 7 – OPTIONAL TOOLS

You may access third-party tools via the Services, provided “as is” and “as available,” without warranties or endorsements. We disclaim all liability related to your use of such tools. Your use is entirely at your own risk and subject to the third-party provider’s terms. New features may be offered in the future and will be subject to these Terms.

We do not warrant and are not responsible for the content or accuracy of third-party materials or websites, or for any damage or harm related to your access to, purchase, or use of third-party products, services, or content. SECTION 9 – RELATIONSHIP WITH SHOPIFY

Air Filtration is powered by Shopify, which enables us to provide the Services. However, sales and purchases made in our store are transacted directly with Air Filtration. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Air Filtration, including any injury, damage, or loss arising from products or services purchased. You expressly release Shopify and its affiliates from any claims, damages, and liabilities arising from your purchases and transactions with Air Filtration.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy [LINK]. Certain data may also be subject to Shopify’s Privacy Policy. Because Shopify hosts the Services, Shopify may collect and process information about your access and use to provide and improve the Services. EXCEPT AS EXPRESSLY STATED BY AIR FILTRATION, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE USE. SOME JURISDICTIONS LIMIT DISCLAIMERS; SOME OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL AIR FILTRATION, ITS PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, OR LICENSORS (OR SHOPIFY AND ITS AFFILIATES) BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES (INCLUDING LOST PROFITS, REVENUE, SAVINGS, DATA, REPLACEMENT COSTS, OR SIMILAR), WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS OBTAINED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Air Filtration, Shopify, and their affiliates, officers, directors, employees, agents, licensors, and service providers from any third-party claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (1) your breach of these Terms or referenced documents; (2) your violation of any law or third-party right; or (3) your access to or use of the Services. We will notify you of any indemnifiable claim and may control its defense; you will cooperate.

SECTION 18 – SEVERABILITY

If any provision of these Terms is held illegal, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed, without affecting the validity of the remaining provisions.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise any right is not a waiver. These Terms, together with any policies posted on the site, constitute the entire agreement between you and us and supersede all prior agreements and communications.

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or delegate these Terms and our rights and obligations without consent.

SECTION 21 – GOVERNING LAW

These Terms and any separate agreements under which we provide Services are governed by the laws of the Province of Québec, Canada. You and Air Filtration consent to the exclusive jurisdiction and venue of the courts located in Québec.
